  1. ACCEPTANCE OF TERMS

    2. "RCKC Website" RCKC Web pages, are the Web Pages of the Rotary Club of Kagitingang Cubao, Quezon City, District 3780, Republic of the Philippines, operated by RCKC on the World Wide Web of the Internet, consisting of information services and content provided by RCKC. "Viewer" means each person who surfs/views or accesses a web page or pages of the RCKC Web Pages.

  2. GENERAL NOTICES

    1. This Agreement, which incorporates by reference other provisions applicable to the use of the RCKC Website, sets forth the terms and conditions that apply to use of The RCKC Web Pages by Viewer. By using The RCKC Web Pages (other than to read this Agreement for the first time), Viewer agrees to comply with all of the terms and conditions hereof. Viewer must comply fully with the provisions of this Agreement.

    2. RCKC shall have the right at any time to change or discontinue any aspect or feature of The RCKC Web Pages, including, but not limited to, content, hours of availability, and equipment needed for access or use. RCKC shall have the right at any time to change or modify the terms and conditions applicable to the Viewer's use of The RCKC Web Pages, or any part thereof, or to impose new conditions. Such changes, modifications, additions or deletions shall be effective immediately even without notice thereof, or with due notice, which may be given by means including, but not limited to, posting on The RCKC Web Pages, or by electronic or conventional mail, or by any other means by which the Viewer obtains notice thereof.

    3. The RCKC Web Pages contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of The RCKC Web Pages are copyrighted as a collective work under the Philippine copyright laws and International copyright laws. RCKC owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Viewer may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission or publication will be permitted without the express permission of RCKC and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Viewer acknowledges that it does not acquire any ownership rights by downloading or viewing copyrighted material.

    4. The RCKC web pages is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. RCKC does not warrant that the service will meet your requirements and will be uninterrupted, timely, secure, or error-free. RCKC and its employees shall have no liability for investment decisions based on the information provided.

     

  3. VIEWER OBLIGATIONS

    1. The Viewer shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of The RCKC Web Pages and all charges related thereto.

    2. Viewer shall use The RCKC Web Pages for lawful purposes only. Viewer shall not transmit or apply material from The RCKC Web Pages which violates or infringes in any way upon the rights of others, and use it to an activity which is unlawful, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without RCKC's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Viewer that in RCKC's discretion restricts or inhibits any other Viewer from using or enjoying The RCKC Web Pages will not be permitted.

    3. Viewer agrees to indemnify and hold RCKC and its employees harmless from any claim or demand, including reasonable attorneys' fees due to or arising out the viewer's use of the RCKC Web Pages, connection to the RCKC Web Pages, violation of his agreement, or violation of any rights of another.

    4. Viewer expressly agrees that use of the RCKC web pages is at viewer's sole risk. Neither RCKC, nor any of their respective employees, warrant that the RCKC web pages will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the RCKC web pages, or as to the accuracy, reliability or content of any information, service, or merchandise provided through the RCKC web pages. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Viewer specifically acknowledges that RCKC is not liable for the defamatory, offensive or illegal conduct of other viewers or third parties and that the risk of injury from the foregoing rests entirely with viewer.

    5. In no event will RCKC, be liable for any loss or damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the RCKC web pages. Viewer hereby acknowledges that the provisions of this section shall apply to all content on the RCKC web pages.

     

  4. TRADEMARKS


    5. All other trademarks appearing on The RCKC Web Pages are the property of their respective owners.

  5. THIRD PARTY CONTENT

Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Viewers or any other user of The RCKC Web Pages, are those of the respective author(s) or distributor(s) and not of RCKC. Neither RCKC nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.

  6. Miscellaneous


This Agreement and any operating rules for The RCKC Web Pages established by RCKC constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the Republic of the Philippines and international copyright laws, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
